I have the suspicion that by this stage in his ruling the judge had ceased to treat the case very seriously?

I have a suspicion that if the judge to not take it seriously enough the whole thing might very well go another round. That said without reading anything else but what you showed me.

Scots Law is a bit different to both the English common law and some other European models. In particular its common for judges to provide guidance about his/her thinking to both prosecution and defence during a trial. In this case he warned the group bringing the case to make sure they stuck to a line of argument he was prepared to take seriously - and they didn't (a number of times). Given this advice, his judgement was quite deliberately an attempt to set out exactly why he was ignoring the arguments they did make.
