On the first turn I sent Polk and 3 other leaders that I wanted to be rid of to that Fort just east of Paducah. Then I pulled my garrisons out. After the Union took the fort a couple turns later, I tried to promote into what should have been an empty 3-star slot and couldn't.

When I look at the map, I see that there are still 4 leader boxes in that fort along with a Union brigade. When I look at the list of my leaders, Polk is gone but the slot is not vacant.

I've never had this problem if there is a brigade that also dies with the fort, i.e. Butler dies just fine when Ft Monroe falls to the CSA.

Have you registered your copy of FoF yet? If not then please do so and them to go the members area and search for the game you want. the patch should be there. Don't use the link if it's not working right.

Methinks you have the wrong thread cesteman.

Anyways, has anyone else seen this? Polk is still in that fort with two Union brigades.

uh yeah I was posting in another thread when I tried to install the spell check. I did reply to your post tho. Honestly, if a fort is taken the general in question should be captured. Maybe he's a spy or traitor? Just kidding.

Yes, the code to destroy generals is called when the fort is captured at the end of a siege.  If there are no troops defending the fort, then the siege code is never called and instead the fort is captured with the province-is-captured code -- this does not trigger the destruction of all the generals inside the fort.  So maybe Polk et al. are just hiding in the bushes outside the fort... :-)  Abandoning forts to destroy generals isn't something we thought to test!  I'll add to the list of things to consider changing, but I don't think it's a critical issue.

It is possible for the brigade to die after the siege (for various reasons) and then trigger the different conquest type... but your chances of suiciding your generals is greater that way.
