When I click the update button I am told one is available and then when it goes to the site it says the update is for Distant Worlds only and not compatable with ROTS. When I click cancel (as it suggests) it downloads the update anyway. If I am on the ROTS page why is it trying to update the basic game??

Where are you trying to update from?

I have always updated from the start menu folder distant worlds Link 'Update Distant Worlds' and never had a problem, although ive heard the server sometimes goes wonky and doesnt download because its busy. Never tried from the quick launch menu or from within the game.
