Ok,

Construction ships on auto keep building in other player sphere of influence, any way to stop this?

No not at war, It's just the other empires complain about it leading to a down rating of how friendly we are regarded.

I’d just rather my construction ships did not do this, is it switchable?

Every new round i actual don't do them auto i play them manually that way I know where my stuff is because i built them there.
Do the same with explorers, feel like I'm the one who orders them to explore.

yeah I've used them on manual before better control true... just quite a bit more micro, having said that I've switched them to manual now as they are over producing mines.

No, no mining rights, so I just gave them the disputed mines in their system. it's happened twice so far in the same system.

If they are on auto it is possible that your AI decided to build mining stations in certain systems. In the mean time the AI empire expanded its influence to include those systems, however your constructors which are on auto would still build there.

a possibility?

I had this happen in my current game.

I believe its when a constructor creates a mine in neutral territory that is close to a newly founded other empires colony. As that colony expands the border expands eventually encompassing the formerly neutral system making the mine offend the other empire.

Hmmm

I'd like to say I agree with dazoline explanation but I've had to give away mine in the same system twice, I'm assuming they where not the same mines but new ones build by my construction ships.

The SOI can shrink as well as expands, I guess.

I had great fun taking over the former homeworld of an empire in a shared system. Before I took over it was 2/3 "yellow", rest red. Just after I took the colony, it was all "red" (I was blue), with a tiny blue blob if turned in. As the colony recovered it got more and more "blue" parts of the sphere of influence, but it switched between red and blue quite a few times.

This probably because the strategic values of the two colonies were quite equal, and who was dominant kept changing.

I solved the issue by conquering the other one...
