"The purpose of the Fair Use Doctrine is to allow for limited and reasonable uses as long as the use does not interfere with owners’ rights or impede their right to do with the work as they wish." - Sara Hawkins, lawyer "...the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; the nature of the copyrighted work; the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and the effect of the use upon the potential market for or value of the copyrighted work." Source: 17 USC Section 107. Commissioned fan art. Will Mr. Massey be selling these images to anyone else? If not, please drop it, because even if he uses a lawyer, he's not getting anything but a loss of exposure for future commissions. phi6 isn't getting anything out of this, and Mr. Massey isn't losing anything. Nobody is getting commissioned to do artwork for fan-made modifications of games, and nor should they, because there is no money made in these mods- unlike Elite: Dangerous' fan commissions. Actually, you can't make money making artwork for game mods, because that money should go to the game publisher unless they give you rights to the game (*in most cases). I also agree phi6 should have asked first, but saying no to the unasked question is far more questionable. If you happen to see this, Kevin, please consider what could be accomplished by trying to remove your works here. Disappointment and a perhaps wizened phi6. Unless it's your objective to force all mods to be made official using only material authorized by the game publishers, in which case we are enemies. The sort of enemies who want to see the other living in a homeless shelter. But hey, that's not how it works right now, so let's just be friendly! This is great artwork, and I'm adding the DeviantArt page to my bookmarks.
