It is not gamey, nor is it a bug. It is a TOAW III feature. See the manual on page 19, section 8.2.9, second bullet.

When we redesign the turn sequence to do away with P1/P2 asymmetries, this clumsy workaround will be changed. However, we deliberately left that engine behavior in, and classified it as a feature, to rectify the detrimental effect that disallowing the action would have against P2.

That is a good article, I printed it out and will be using it to try and survive the Fire in the East game I am in as the Russians[:D]
