Basically, you should never leave more than one turn's population unused at the end of your turn. IIRC, that means Germany should never have more than 11 in their pool after production and Japan never more than 8. Yes, Japan can declare war on Russia without Germany declaring war. That will just unfreeze the Eastern and Central Soviet Zones, but it's very hard for Japan to take on Russia in a land war without German help.
