Stating the manual on page 202:

Sounds like you can only build forts to ABOVE lvl 2 IF an enemy unit is WITHIN 25 hexes?

Is this correct?

Reason for doubt is that I actually had gotten the impression in these forums that it was the other way around, can only go above lvl 2 if more than 25 hexes from enemy.

You can definitely go above level 2 if the enemy is wihin 25 hexes.
