I was playing a small map with five or six other races and my reputation was respectable. After exploring all the systems I found one last race that as a side note was probably and independent turned empire. But, that's not what the question is. I had him at the friendly or delighted disposition toward me and we also had a free trade agreement. Even with both of those going for me he was still attacking my ships when they came to trade with him. Eventually after warning him about it at least twice I attacked and destroyed his ships that were attacking me.

Now for some reason my reputation is diabolical and I have between -95 and -50 with most of the other races, just for stopping his attacks. this doesn't really make sense. Is it because I didn't cancel the trade agreement first? and if so why could he attack me with it still on? and then another question would be why is there not a warning like "hey if you attack this guy while you still have this treaty that he broke first, then you will f*#% up your reputation."?

The race that is attacking you is probably unreliable - look at thier traits in the diplomacy screen or the galactopedia.

Also their rep should be taking big hits for attacking you in the first place. Break your trade agreement with them and put on an embargo and declare war on them before you attack them.

RP mode: You fell into their cunningly laid trap to ruin your rep with the rest of the galaxy.

Ah so the game is more realistic than I was thinking. we must sign a form in triplicate twice before we can fight :D
