In 2.3.0, when I try to spend 4 surprise points to avoid combat, it goes right into choose combat type. Try setting the die rolls to any numbers that give either side at least 4 points, and see for yourself. I first tried to have the Germans avoid battle, and thought, "Wow, the RN is inexorable".

Yes this is one of the bugs in 2.3.0 that are being worked on for a hot patch soon. Thanks for the save.
