Maybe there's another way to think about what spotting and surprise might mean in land combat at the time and distance scale of this game. Perhaps it would be helpful to think of spotting as not just knowing in a general way that a unit is in a hex, but having enough intel about the unit's dispositions over several square miles of terrain to mount an effective, sustained attack. So, if FOW doesn't allow you to "see" that a hex has a unit in it, yet you suspect there is, then charging into that hex might be best understood not as a single ambush (games-turns cover days after all) but as a series of very hasty, ill-informed attacks based on limited intel about the enemy unit's exact dispositions.
