In 1940 Germany turns west against France and its allies. Things go quite well. Italy joins the Axis, and starts moving some armies to Tripoli. Germany refuses Vichy, the campaign continues, and the French capital switches to Algiers. Graziani and his forces move into Tunisia, and then into Algeria, while the German forces mop up Continental France. Algiers falls to the Italians ... and FRANCE SURRENDERS - TO THE ITALIANS!

For the rest of the game, Italy gets ALL of the conquered French MMPs (including continental France). Germany gets none, and now has to conduct Barbarossa on a shoestring.

Does anyone else see a problem in this? [&:]

Nope. Basically it's up to the player to pick who gets what based on who take the capital.

There are been case of the USSR surrendering to Italy because the only unit with enough movement point to take the last city was an italian one. :)

It usually works the other way around, Germany does the heavy fighting and gift the capital to Italy to shore up its income.

Of course, that is the pragmatic solution to the "problem".

I would still prefer having the French empire dissolving into its constituent parts: Continental France, Algeria, Tunisia and the Levant. Then, when Italy takes out Tunisia, it becomes Italian. The same occurs when the "French" capital of Algiers is taken over by the Italians. However, when Algerian "France" surrenders, the current occupier of Paris should gain control over continental France. At that moment, should there be no power presence in Damascus, the Levant could tilt its allegiance towards a Free France (most likely) or to neutrality (Arab-nationalism).

Is my suggestion not far more elegant that the existing - cheesy - "solution".

If the goal is piecing out the parts, do it through Vichy and which allows declaring war on the bits and partitioning as needed. The idea of the rejection to the french peace overture is the 'winner takes all' proposition.

Once you know how the surrender system works you plan a bit to parse out the empires as needed (which isn't much of a hassle). It's really just a problem you encounter once when you don't know it.

I know how the surrender system works: in a very gamey way.

I am suggesting a change to this lazy system ... a way that will make it a whole lot more historically sensible. It is a game, but not really a plausible one about WW2.
