Agreed; that said I have a bias against the 50% restriction in the first place. I think SHQ troops and equipment should definitely count, but you may not being seeing the whole picture at the first screen (see below). You can work around the restrictrions with upgrades too, so long as you have enough for the most basic unit or formation (i.e. independent battalion or brigade OOB). I have suggested just enough to fulfill the 100 troops in each unit created. At the players option, allow raising the unit as a straw-man and allow the replacement system to fill it up. I am unaware of how this could be used as an exploit other than perhaps disposable blocking formations. Perhaps make the units immobile until they reach 50%. Raise Formation is already restricted to a friendly supply route with a connection to the SHQ. The other issue is that unless you get to the next screen (per the image)--to complete the raise formation command, so you can't see the numbers being used for 50% -- troops, items, logistics -- and the costs, which is very helpful.
