1) The rules say that if you capture a port any ships inside it will be captured as well. However, I've noticed that the country will get it's move after their capital is conquered and subsequently will move the ships out. For example, I had a Norwegian merchant sitting in Copenhagen, and then I received the message that Copenhagen surrenders to me. Next thing I see is the Norwegian merchant sail out of port to freedom. I think that at the moment the surrender of a country is triggered through the occupation of it's capitol, all of it's forces should be frozen and the country should not process any additional moves or actions. 2) Sometimes units remain even though the country is conquered. Like in the example above, I had another Norwegian merchant sitting in Jutland. I conquered the capitol, all of their provinces turned mine, but the next turn the Norwegian merchant was still in Jutland, with the Norwegian flag and everything. This might be related but I've also had nations declare war on countries that no longer existed.
