Why can't I build a base in enemy territory if I am at war with them?

If I'm at war with an empire and I want to build defensive bases in their territory to support my war effort I can not because it is "in another empire's territory". That makes sense if we are at peace but doesn't make sense if we are at war. So, until I invade their colony my ships are on their own with no support? Or, have I missed something?

I take your point. You are allowed to colonize enemy territory if you are at war but not simply build a base. That is sorta messed up.

Add it to the list!

If it is fuel you need, the role of the colony built resupply ship is available. Put gas mines to rate about 100 and lots of cargo (30-50k). Also have at least 10 docking bays, otherwise the refueling ships will pile up waiting in queue. You tell a resupply ship to deploy at a fuel source gas giant with high percentages, or into a gas cloud with fuel. Don't worry about other gases at gas giants besides fuel, they are not mined. I hope this helps, and if you have cloaking technology, put cloaks on the resupply ship.

p.s. I don't build them anymore, just put five to eight Hakonish fuel tanks on my ships. You can cross the galaxy, fight, and return on 1000 fuel if you have Quameno reactors.

Look, you build your colony at another Empire space.
If there is another colony at the same system your Colony can't generate enough influnce to raise a terrirtory there.
If your colony is just at the influence area of the other empire, you need to wait until your colony raise their own influence, then you can build stations there.
But a Spaceport you allways should build at the Colony i think.

None of the above really answers the question. Though unfortunately the answer really just is "because you can't".
But as jeeves said the resupply ship is your only alternative. Or As canute said a colony followed by a space port.

The resupply ship will be so big (movable base) that you can afford the space for cloaks, and being near enemy territory, you don't want it spotted as it sucks up fuel for your battle fleet. Otherwise you don't need cloaks.

I'll have to try cloaks. I never saw any point in them - as it didn't seem to have any effect on the AI's reaction to fleets/ships. But that was a while ago. Perhaps Elliot has fixed it... and it was never noted in any of the release notes.

A Cloak? On a resupply ship? You must be joking. Those things are huge, a cloak would be utterly worthless. Cloaks only work on very tiny ships. And resupply ships don't really have a fuel limit, they suction fuel off the gas giant you park them on....and honestly, it's impossible since they added the arbitrary composition requirements to build a useful resupply ship anyway, since it requires so ridiculously many cargo bays just to function that it rapidly becomes a purposeless exercise. I don't think I've ever used a resupply ship since 1.03-ish, when they stopped being a method of producing a gargantuan monster ship that would dwarf even a Death Star. What the hell would anything need 300 cargo bays for, anyway?

Silly goose, you don't put just one cloak on the ship, you keep adding them until the visibility is zero...
