Looks like there is a small bug in the formula that checks this rule and it allows to attack that single hex. Why have you vacated hexes above? They are protected :) Further south, he should be blocked.

actually, a few of the hexes below the river (below the move line) will produce Finish forts and not German forts. Maybe this is part of the problem. Just a suggestion

My above comment address the Svir river to the northeast. In my game v bobo I have 2 finnish forts up and running below!!!! the svir river.

Finnish forts are built up to y=14 (inclusive). edit: That's not connected to Finnish no-attack line.

Fixed No Attack Line in 1.08. I think only that single hex had bug.
