If there is a layer, great. If there is no layer, carry on." If we made it impossible to set a depth preset when the sub is in a no-layer area, then you, the player, would need to actively keep track of the submarine's location and manually bring up the throttle/depth window to set that preference when the sub is indeed in an area with layer. Which, to me at least, translates to tons of unnecessary micromanagement.
